ALYT Developer Platform Terms of Service

Thank you for building on ALYT. Please read these terms before you create a developer account or use the developer platform. We have tried to keep them short and plain. The short summaries under each heading are for convenience and are not legally binding.
1. Definitions
Section titled “1. Definitions”- “ALYT”, “we”, “us” and “our” mean Fizzify Inc., a company registered in Wyoming, USA, together with its officers, employees, contractors and agents. ALYT is a product name of Fizzify Inc.
- “Developer Platform” or “Platform” means the websites, APIs, sandbox, documentation and tools we offer at developers.alyt.com and related subdomains.
- “Account” means your legal relationship with ALYT as a developer. An Account may belong to an individual or to an organisation.
- “Sandbox” means the free, metered test tenant we give each Account, including its virtual devices.
- “API Key” means a credential we issue to your Account. Keys starting with
alyt_dev_work in the Sandbox. Keys starting withalyt_live_work against a production tenant and are issued only after approval. - “Connector” means an integration you write that lets the ALYT platform control or read a device, service or brand.
- “Submission” means a Connector you send to us for review under the Submission Agreement.
- “Installation” means a running copy of the ALYT platform, whether hosted by us or self-hosted by an operator.
- “Household” means the people whose home an Installation serves.
- “Your Content” means code, descriptors, text, images and other material you upload, submit or create on the Platform.
- “Agreement” means these terms together with the Acceptable Use Policy, the Privacy Policy, the Submission Agreement and, where it applies, the Self-Hosting Terms.
2. Accounts
Section titled “2. Accounts”Short version: a human must create the Account; you must be at least 18; you keep the Account secure; you are responsible for what happens under it.
- You must be at least 18 years old, or the age of majority where you live, to open an Account.
- A human must create the Account. Accounts created by automated means are not permitted.
- You must give a valid email address. If you act for an organisation, you must give its legal name and you confirm you have authority to bind it.
- One person or organisation may hold one free Account. We may close duplicates.
- You are responsible for all activity under your Account, including activity by people you let use it.
- You must keep your password and API Keys secret. Tell us at info@fizzify.co promptly if you believe your Account or a key has been compromised.
- You may not use the Platform in breach of United States export control or sanctions law, and you may not use it if you are a person or entity subject to such restrictions.
3. Approval steps
Section titled “3. Approval steps”Short version: signup is instant; three things need our explicit approval.
- Creating an Account and receiving an
alyt_dev_key happen at signup without review. - The following require a separate, explicit approval from ALYT, which we may grant or refuse at our discretion:
- access to ALYT’s own AI inference from the Sandbox;
- issue of an
alyt_live_key against a production tenant; - publication of a Connector as PUBLIC.
- Approval may be withdrawn if the conditions under which it was granted no longer hold.
4. The Sandbox
Section titled “4. The Sandbox”Short version: free, metered, shared, and not a place to keep anything you cannot lose.
- The Sandbox is provided free of charge today. It is metered from the first request. Ceilings on API calls, messages and AI usage apply and are shown to you before you reach them.
- The Sandbox runs on shared infrastructure, including hardware that also serves real households. Rate limits and quotas protect those households and are binding.
- Sandbox data may be reset, and Sandbox features may change or be withdrawn, at any time. Do not store anything in the Sandbox that you cannot recreate.
- Virtual devices in the Sandbox simulate real devices. Behaviour that works in the Sandbox is not a promise that it works in a real home.
- If we grant you access to ALYT’s AI inference, that access has its own quota and queue and may be paused when real households need the capacity.
5. API Keys
Section titled “5. API Keys”- API Keys are issued to your Account, are shown to you once, and are stored by us in hashed form. We cannot recover a lost key; you must rotate it.
- You may not share a key to evade a rate limit or quota, and you may not use a key issued to another Account.
- Every request made with a key is traced and attributed to that key. See the Privacy Policy for what a trace contains and how long it is kept.
- We may revoke a key at any time. Revocation is immediate and is recorded in the audit log.
6. Acceptable use
Section titled “6. Acceptable use”- Your use of the Platform must comply with all applicable laws.
- You agree to the Acceptable Use Policy at
ACCEPTABLE_USE.md, which is part of this Agreement. In particular, you may not attempt to reach other tenants’ data, other households, or private network addresses from the Platform.
7. Your Content
Section titled “7. Your Content”Short version: you own what you write; you give us the rights we need to run the Platform; the Submission Agreement covers PUBLIC Connectors.
- You own Your Content. You are responsible for it and for any harm it causes.
- You grant ALYT a non-exclusive, worldwide, royalty-free licence to store, copy, display, test and analyse Your Content as needed to operate, secure and improve the Platform. This licence ends when you delete Your Content, except where a Connector has already been distributed under the Submission Agreement.
- Distribution of a Connector to Installations is governed by the Submission Agreement, not by this section.
- We may remove Your Content that breaches this Agreement or applicable law.
- If you send us feedback or suggestions, you allow us to use them without obligation to you.
8. Our intellectual property
Section titled “8. Our intellectual property”- ALYT and its licensors own the Platform, its APIs, documentation, design and trademarks. We reserve all rights not expressly granted.
- Our APIs, documentation and client libraries may be used only to build for the ALYT platform, under the licence that accompanies each of them.
- The ALYT name and logo are trademarks of Fizzify Inc. You may say that a Connector “works with ALYT”. You may not suggest ALYT built, endorses or verifies your work unless we have granted that status.
- This Agreement itself is published under CC0 1.0, adapted from GitHub’s site policies.
9. Fees
Section titled “9. Fees”- The Developer Platform is free of charge today. There is no billing.
- If we introduce fees, quotas that cost money, or a revenue share for paid Connectors, we will give at least 30 days’ notice and you may close your Account before they apply.
10. Suspension and termination
Section titled “10. Suspension and termination”Short version: you can leave any time; we can suspend or close an Account for cause, and will say why when we lawfully can.
- You may close your Account at any time from your settings. We will delete your Account data within 90 days, except records we must keep by law, audit logs, and Connectors already distributed as PUBLIC.
- We may suspend or terminate your Account, keys or approvals immediately if you breach this Agreement, if your activity threatens the Platform or a Household, or if the law requires it.
- Where lawful and practical, we will tell you the reason and give you a way to respond at info@fizzify.co.
- Sections 7, 8, 11, 12, 13 and 15 survive termination.
11. Disclaimer of warranties
Section titled “11. Disclaimer of warranties”We provide the Platform “as is” and “as available”, without warranty of any kind. We disclaim all warranties, express, implied or statutory, including merchantability, fitness for a particular purpose, title and non-infringement. We do not warrant that the Platform will be uninterrupted, timely, secure or error-free, or that the Sandbox behaves like a real home.
12. Limitation of liability
Section titled “12. Limitation of liability”- To the fullest extent permitted by law, ALYT will not be liable for loss of profits, use, goodwill or data, or for indirect, incidental, special, consequential or exemplary damages, arising from your use of or inability to use the Platform.
- ALYT’s total liability under this Agreement is limited to USD 100 or the amount you paid us in the 12 months before the claim, whichever is greater.
- These limits apply whether or not we were told such damages were possible, and even if a remedy fails of its essential purpose.
13. Indemnification
Section titled “13. Indemnification”You agree to defend, indemnify and hold harmless ALYT from claims, liabilities and expenses, including reasonable attorneys’ fees, arising from your use of the Platform, Your Content, your Connectors, or your breach of this Agreement. We will notify you promptly of any such claim and give you reasonable assistance at your expense.
14. Changes to these terms
Section titled “14. Changes to these terms”- We may amend this Agreement. We will give at least 30 days’ notice of material changes by email to your Account address or by a notice on the Platform.
- Your continued use after the notice period is acceptance of the change. If you do not accept, close your Account before the change takes effect.
- Every version is kept in the platform repository with its effective date.
15. Governing law and disputes
Section titled “15. Governing law and disputes”- This Agreement is governed by the laws of the State of California and the federal laws of the United States, without regard to conflict of law rules.
- You and ALYT submit to the exclusive jurisdiction of the state and federal courts located in Los Angeles County, California.
- Nothing in this section limits rights you have under mandatory consumer law where you live.
16. General
Section titled “16. General”- You may not assign this Agreement without our written consent. We may assign it to a successor of the Platform.
- If any part of this Agreement is unenforceable, the rest remains in effect.
- Our failure to enforce a provision is not a waiver.
- This Agreement, with the documents it references, is the entire agreement between you and ALYT about the Developer Platform.
