ALYT Self-Hosting Terms

These terms are between Fizzify Inc. (“ALYT”, “we”) and you, the operator of an ALYT Installation on hardware you control (“Operator”, “you”). They apply the moment you run the platform on your own hardware. If you do not agree, do not install it. Capitalised terms have the meaning given in the Developer Platform Terms of Service.

  1. “Software” means the ALYT platform services, agent, console, app builds and documentation that we make available for self-hosting, in the form we distribute them.
  2. “Installation” means your running copy of the Software.
  3. “ALYT Services” means the central services listed in section 5 that an Installation may reach.
  4. Components under open source licences carry their own licence, which governs those components where it expressly conflicts with these terms. Copies are included in the distribution’s notices.
  1. We grant you a non-exclusive, non-transferable licence to install, run and configure the Software on hardware you own or control, for the number of properties and devices your written agreement with Fizzify Inc. allows.
  2. You may modify configuration, write PRIVATE Connectors, and integrate the Installation with your own systems through its documented APIs.
  3. You may not distribute the Software to others, offer it as a service to anyone other than the Households your Installation serves, or remove notices from it.
  4. This licence does not include ALYT trademarks (section 7) or ALYT Services (section 5).

Short version: it is your hardware, your network, your brand, your household. ALYT vets what it distributes. It does not, and cannot, vet what you install.

  1. You are responsible for the hardware, the network, the operating system, backups, physical security and updates of your Installation.
  2. You are responsible for the Households you serve, for your agreement with them, and for their privacy. ALYT is not a party to that relationship and receives no Household data from a self-hosted Installation unless a declared Connector or an ALYT Service sends it.
  3. You are responsible for applying security updates we publish within [30] days. An Installation that falls behind may lose access to ALYT Services.
  1. A PRIVATE Connector is one you wrote, or installed from any source other than the ALYT catalogue, that ALYT has not approved.
  2. A PRIVATE Connector runs on your Installation only. It cannot reach the ALYT catalogue and is never distributed by ALYT.
  3. Everything about a PRIVATE Connector is your responsibility entirely: what it does, what it reaches, what it sends to any AI model, whether it infringes anyone’s rights, and what happens to a Household because of it.
  4. ALYT has not reviewed it and makes no statement about it. You must not tell a Household, or let your interface imply, that ALYT reviewed or approved it.
  5. Your Installation must show a PRIVATE Connector as such to the Household, using the platform’s distribution-scope indicator, and must not relabel it as PUBLIC or verified.
  6. If you want a Connector to be reviewed and distributed, submit it under the Submission Agreement. Approval is at ALYT’s discretion.

5. ALYT Services an Installation may reach

An Installation is designed to run with the internet unplugged. The following ALYT Services are the only ones it reaches, all outbound, and all optional except where stated:

No other ALYT service is reachable from an Installation, and an Installation sends no telemetry to ALYT unless you turn it on. Use of ALYT Services is subject to the Acceptable Use Policy.

  1. You may rebrand a self-hosted Installation: your name, logo, colours and domain on the console and app you distribute to your Households.
  2. White label is permitted only when self-hosted. An Installation hosted by ALYT carries the ALYT brand.
  3. A white-labelled Installation must keep, unaltered, the following: the open source notices, the distribution-scope indicator for Connectors, the AI declaration shown before install, and any Household control that revokes a Connector.
  4. You may not present a white-labelled Installation as ALYT, or as ALYT-reviewed beyond the PUBLIC Connectors it pulls from the catalogue.
  5. Where a PUBLIC Connector’s page names its developer and support contact, you must show that, so the Household knows who answers.
  6. Commercial terms for white label are negotiated contract by contract and are not part of these terms.
  1. ALYT, the ALYT logo, ALYT Voice and related marks are trademarks of Fizzify Inc. The licence in section 2 does not cover them.
  2. Without a written trademark licence you may say, in plain text, that your product “runs on ALYT” or “is powered by ALYT”, and you may link to alyt.com. You may not use the ALYT logo, combine our marks with yours, register a domain or company name containing ALYT, or use our marks in a way that suggests we operate or endorse your Installation.
  3. Our current logo guidance is available from info@fizzify.co. If it conflicts with this section, this section wins for self-hosted Installations.
  4. We may ask you to stop a use of our marks that we consider misleading, and you will stop within [10] days.
  1. The Software is provided “as is” and “as available” as to any software, Connector, model, configuration or hardware you add to an Installation that we did not distribute.
  2. We give no warranty that operator-added software will work, is secure, or will keep working after an update we publish.
  3. We have no obligation to support a problem caused by operator-added software, and we may decline support until it is removed.
  4. If operator-added software causes an Installation to breach the Acceptable Use Policy against ALYT Services, we may cut that Installation off from those services.
  1. Beyond section 8, the Software is provided “as is” and “as available”, without warranty of any kind, express, implied or statutory, including merchantability, fitness for a particular purpose, title and non-infringement. Any warranty beyond this section exists only in a paid support agreement, negotiated contract by contract.
  2. To the fullest extent permitted by law, ALYT is not liable for indirect, incidental, special, consequential or exemplary damages, including loss of profits, data or goodwill, arising from an Installation, from a PRIVATE Connector, from operator-added software, or from a Household’s use of your Installation.
  3. ALYT’s total liability under these terms is limited to the amount you paid us for the Software in the 12 months before the claim, or USD 100 if you paid nothing.

You will defend, indemnify and hold harmless ALYT from claims and expenses, including reasonable attorneys’ fees, arising from your Installation, your PRIVATE Connectors, operator-added software, your use of our marks, your agreement with your Households, or your breach of these terms.

  1. These terms last while you run an Installation.
  2. You may end them by stopping the Installation and deleting the Software.
  3. We may end them, or cut an Installation off from ALYT Services, if you breach them materially and do not cure within [30] days of notice, or immediately where Households or the Platform are endangered.
  4. Sections 3, 4, 7, 8, 9 and 10 survive.

We may change these terms on 30 days’ notice by email to the operator address on file or a notice in the distribution. If you do not accept, stop the Installation before the change takes effect. Updates to the Software may carry updated terms; installing the update is acceptance.

  1. California law governs. The state and federal courts of Los Angeles County, California have exclusive jurisdiction.
  2. You may not assign these terms without our consent. We may assign them to a successor of the Software.
  3. If any part is unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver.
